            On November 5, voters will cast their ballots for, among others, half the California State Senate seats and all of the Assembly seats. On December 2, the Legislature will convene their 2025-26 Legislative Session. So, how many new legislators will be seated at that time?

For the State Senate, assuming the status quo regarding those state Senators running for re-election (i.e., that they will win their seats again next month), there will be 12 new state Senators (note, however, that 4 sitting Assembly Members are likely to win senate seats, so those could be excluded from the count of 12 “new” senators).

The following are the 12 departing Senators, in alphabetical order (along with their party affiliation and district number), and whether their departure is due to term limits or whether they have additional years to serve:

Toni Atkins (D) – SD 39 – due to term limits

Steve Bradford (D) – SD 35 – due to term limits

Brian Dahle (R) – SD 1 – due to term limits

Bill Dodd (D) – SD 3 – due to term limits

Susan Talamantes Eggman (D) – SD 5 – due to term limits

Steve Glazer (D) – SD 7 – due to term limits

Dave Min (D) – SD 37 – running for Congress – has 8 years remaining

Janet Nguyen (R) – SD 36 – running for board of supervisors – has 4 years remaining

Anthony Portantino (D) – SD 25 – due to term limits

Richard Roth (D) – SD 31 – due to term limits

Nancy Skinner (D) – SD 9 – due to term limits

Scott Wilk (R) – SD 21 – due to term limits

Can Any Bill Call an Election?  By Chris Micheli             In June 2024, we saw two bills that contain a provision to call an election.             Both bills contain a “plus” section at the end of the bill, which is an uncodified statute, stating the following: “this act calls an election within the meaning of Article IV of the California Constitution and shall go into immediate effect.” Such a measure only requires a majority vote, unless some other constitutional provision requires a higher vote threshold (e.g., a tax increase). What is the basis for this statement? Section 8(c)(3) of Article IV of the state Constitution provides: “ Statutes calling elections, statutes providing for tax levies or appropriations for the usual current expenses of the State, and urgency statutes shall go into effect immediately upon their enactment.” However, there is no further guidance in the Constitution, nor in any California Code, regarding what a “statute calling an election” looks like o
